Terms and Conditions

By using the Guardarian service you accept the terms and conditions set out in this document. Please read them carefully: they govern the mutual rights and obligations and define what you can expect from us and what we expect from you.

Last updated: 4 May 2026

1. Preliminary remarks

These terms govern the contractual relationship between Guardarian S.r.l.(hereinafter "Guardarian" or "we") and the user of the payment and digital asset purchase service accessible from the website. Completing a payment constitutes full and unconditional acceptance of these terms.

2. Service offered

Guardarian provides a secure payment interface for the purchase of digital assets and related services. The actual payment transaction is processed by an electronic money institution authorised by the European Central Bank, in accordance with the PSD2 directive and the applicable anti-money-laundering legislation.

3. Eligibility requirements

To use the service you must:

  • be at least 18 years of age;
  • have full legal capacity;
  • provide truthful, complete and up-to-date personal and payment details;
  • be the legitimate holder of the payment instrument used.

4. Prices and fees

The amount due is clearly indicated at checkout, before the payment is confirmed. All amounts include VAT at 20% calculated in accordance with applicable tax law, and any service fees are shown separately in the summary. Once the payment has been confirmed, you will receive a fiscal receipt at the email address provided.

5. User obligations

The user undertakes to:

  • not use the service for unlawful, fraudulent purposes or in breach of the rights of others;
  • not attempt to gain access to systems, data or restricted areas (including by injection, brute-force attacks or automated scraping);
  • not share their payment credentials with third parties;
  • promptly report any unauthorised use of their payment instrument.

Any breach may result in immediate suspension of the service, invalidation of the transaction and, where the circumstances so warrant, referral to the competent authorities.

6. Right of withdrawal

Given the nature of the service provided (immediate execution of a financial transaction with the user's explicit consent), pursuant to Art. 59(a) and (n) of the Italian Consumer Code the right of withdrawal does not apply once the transaction has been completed. Save as otherwise provided in our refund policy in respect of failed or erroneous transactions.

7. Limitations of liability

Guardarian is liable for direct damage caused by its own intent or gross negligence up to the maximum limit of the amount of the disputed transaction. We are not liable for:

  • unavailability of the service due to force majeure or interruptions affecting third-party providers (banks, payment gateways, hosting);
  • unauthorised use of payment data by third parties where the event is attributable to the user's negligence in safeguarding their credentials;
  • indirect damage, loss of profit or loss of opportunity.

8. Intellectual property

The Guardarian trademark, logo, interface design, texts and any other content of the website are the exclusive property of Guardarian S.r.l. and are protected by national and EU copyright and trademark law. Any use not expressly authorised is prohibited.

9. Changes to the terms

We may update these terms at any time to reflect legal or technical developments. The changes take effect from the date of publication and apply to subsequent transactions. The version in force is always the one published on this page.

10. Applicable law and jurisdiction

These terms are governed by Italian law. For any dispute arising from or connected with the service, where the consumer does not reside in Italy, the courts of the consumer's place of residence or domicile shall have exclusive jurisdiction if that place is within the territory of the European Union. For business-to-business relationships the courts of Milan shall have exclusive jurisdiction.

11. Alternative dispute resolution

Before resorting to legal proceedings, we invite you to contact us by writing to info@guardarian.com: in our experience most disputes are resolved quickly and amicably. Should an agreement not be possible, you may use the European Commission's ODR platform: ec.europa.eu/consumers/odr.

Your data is safe.

We do not sell, transfer or share your information with third parties. End-to-end TLS 1.3 encryption, GDPR compliance and automatic deletion of payment data at the end of the transaction.
